Politics na your mate?

In 6 months time, I won't be surprised that Fubara and the Rivers house of assembly would all defect to APC.

Tinubu gave him a life line to prevent the River state house of assembly from impeaching him.

This is politics...one will clearly see a strong politician is advising this Edo Governor....make peace with opposing LG Chairmen and get their buy-in with time...and this is exactly what Gov Fubara should have done....proper rapport with the Lawmakers for save us all these drama

Fubara and the lawmakers should close ranks..

This is the only available commonsense voice of reasoning..

They should not listen to noises advising them to go to court...na long route be that.

Close ranks and meet the President say all is now well...simple.

In other words, the President suspended a democratically elected Governor, not because he has any constitutional powers to do so, but because there is no law preventing him from doing so?

Think of it this way. If there was no law on state emergency, would Tinubu have the right to declare state of emergency because there's no law preventing him from declaring one?

Can you please clarify what EXTRAORDINARY MEASURES mean in that Section 305 3C Falz posted

Hmmmm..

Section 305 3c of the constitution...The President shall have power to issue a state of emergency only when:
There is breakdown of public order or public safety in any part of the federation to such extent that it requires extraordinary measures to restore peace and order.

What exactly can we say are Extraordinary Measures

I believe this is very broad, and may include suspension of elected officers in that state.

The state remains safe, secure, and peaceful under my watch. Rivers people have always been resilient, and we will face this situation with wisdom, patience, and unwavering faith in the democratic process,” he added.

Mr Governor, you didn't distance yourself from threats going from militants to attack oil installations...

You even said you will tell your boys when to act...

And then, you didn't condemn the bombing of oil installations...which is of interest to the FGN.

These are loopholes.

"The NBA questions whether the political crisis in Rivers State has reached the level of a complete breakdown of law and order warranting the removal of the Governor and his istration. "

The two oil infrastructure bombing incidents cannot be overlooked by the FGN, especially when it seems the State Government was I not bothered and no official communication condemning threats from militants corner, prior to the bombing by the Governor.

I am not a lawyer, but the constitution empowers the President to use any measures to restore constitutional order during state of emergency. This is a very broad provision

You have a point...but if they feel they are limiting, and this method will be easier for them...the point is to crackdown on all forms of criminality

But kidnappers are hiding in the bush with hostages and you think bloggers hiding behind key pad should be your priority as well as that of the senators.

are the senators able to nigerians?

should that not be the priority?

are they taking part of the responsibility for bad governance and for not properly supervising the executive but being a rubber stamp to the executive?

Deliberate falsehood is a crime. Just like kidnappers are criminals.

Government should crack down on every form of criminality

"Commissioner for Information and Communications, Joe Johnson, criticised the legislators’ rigid stance against compromise and their refusal to work towards moving the state forward."

Mr Commissioner, tell your principal to find a political solution...He is also not innocent. He withheld the entitlement of these guys for months...is it easy They are also in politics for their very own selfish interests..and that interest was blocked by the Governor.

So, it's time for yh Governor to find a political solution...beg them, if necessary. These ones dey carry palm oil...don't let them stain the Governor. If na begging he go do..let him beg them

So you can see that the supreme Court judge that said only speaker can declare a seat vacant is definitely high on substance or has been highly compromised
.

I think they tends towards due process.

The case of that LP lawmaker, he defected at the floor of the house..and his defection was announced at the floor of the house by the speaker.

Then, the Labour party that sponsored him now approach the court to sack him.

This is due process the PDP in Rivers State should have taken. Not demolition the house of assembly.

I am not a lawyer..but this is what I can understand from Supreme Court judgement. It's only the speaker that can declare defection and then, aggrieved parties will approach the court. That's due process
adioolayi(m): 6:38am On Mar 18
Hoelujohn:

The Supreme Court on Friday, April 14, ordered an Ondo State lawmaker, Ifedayo Abegunde, representing Akure South/North Federal Constituency, to vacate his seat following his defection from Labour Party (LP) to the defunct Action Congress of Nigeria (ACN).

A Seven-man of Justices of the court, headed by the Chief Justice of Nigeria, Justice Mahmud Mohammed, declared that Abegunde is not fit to remain at the legislative house, noting that the lawmaker acted illegally by abandoning the party that sponsored his election.

It said that the lawmaker’s defection to another party would have been justified if there was a division in the national structures of the LP, such that is capable of impeding the smooth operation of the party.

The Supreme Court stated that the “division” or “factionalisation” of Labour Party, which was cited by the lawmaker as his excuse for abandoning the party, was only at the state level.

Abegunde was elected into the parliament on the platform of the ruling Labour Party (LP) in the April 2011 general elections, but defected to the Action Congress of Nigeria (ACN) after a few months in the House.

Labour Party subsequently began a recall process against him and approached the court to sack the decampee lawmaker in order for the party to reclaim his seat.

The lawmaker also filed a counter motion seeking judicial protection against his recall by the Ondo State House of Assembly.

You see...is LP, now PDP in the case of Rivers State

How can LP proof these lawmakers are not of PDP Is the PDP now with the LP

Law is not emotions ....na PDP get better case, unfortunately, it was withdrawn...they were played
adioolayi(m): 6:32am On Mar 18
Them go follow Supreme Court Judgement..

Moreso, certified true copy was presented...that one don go far!

The Federal High Court Judge go also say the House of Assembly Complex was demolished and the issue of defection can't be proofed.
