The recent Supreme Court judgement expounded the provision of section 7 (1) that governors must ensure the existence of democratically elected LG councils. In fact, the effect of the judgement is that it basically nullifies any provision in any Local Government Law that empowers the governor to unilaterally suspend a Local Government Council. Where does Okpepbolo even think he has the authority to do that from? The Supreme Court has clarified the constitutionality of this practise in the case of AGF V AG, Abia & 36 ors. That decision is binding on lower courts. There's no magic any court will perform. |
