Constitutional lawyer and Senior Advocate of Nigeria, Mike Ozekhome, has slammed the Supreme Court over its recent ruling that affirmed the death sentence of Adamawa Christian farmer Sunday Jackson for defending himself against a killer herdsman

In a ruling on March 7, 2025, the apex court upheld a lower court decision sentencing Mr Jackson to death by hanging for killing a Fulani herdsman, Ardo Bawuro, in an altercation on his farmland over 10 years ago, sparking widespread outrage over what the defence and critics said was a self-defence act.

Mr Ozekhome, who is currently representing the embattled leader of the Indigenous People of Biafra, Nnamdi Kanu, in his high-profile terrorism case against the Nigerian government, has now become the latest public figure to criticise the Supreme Court’s verdict condemning Mr Jackson to the death penalty.

In his analysis of the apex court’s verdict, Mr Ozekhome said the conclusion of the Supreme Court raised serious concerns about fairness and the fundamental right of every Nigerian to defend themselves.

He stated that justices were unrealistic to determine Mr Jackson should have fled after subduing his attacker.

“The facts surrounding the case raised significant questions about fairness, judicial reasoning and the fundamental right to self-defence,” Mr Ozekhome said.“The court reasoned that having seized the dagger, Jackson no longer faced an imminent threat and should have fled instead of retaliating with deadly force.”

He added, “This position has been widely criticised as unrealistic and disconnected from the realities of violent encounters.”

Mr Ozekhome also noted that Mr Jackson has maintained consistent claims of the incident, arguing that the defendant was right to instinctively react in the heat of the moment to defend himself against his attacker, which subsequently resulted in his death.

He insisted that the stabbing that resulted in the death of Mr Bawuro occurred during a physical struggle, and the justices’ notion that Mr Jackson had the opportunity to flee to safety while in a confrontation against an armed attacker was impossible.

“Jackson’s claim was consistent and straightforward; he acted instinctively to preserve his life in the face of sudden, life-threatening danger. The stabbing occurred during a physical struggle,” Mr Ozekhome argued.


“The notion that he had a clear and safe opportunity to flee while entangled in a fight with an armed opponent is, at best, speculative and, at worst, a dangerous oversimplification of a clear and perfect danger to his life. The apex court appeared to construct a simplistic mental narrative that did not align with the raw, chaotic nature of real-life violence.”

The senior lawyer added that the apex court erred in its handling of the case, stating that it violated the constitution by delivering judgment 167 days after the close of the argument, when it had a maximum of 90 days.

I think Christians allowed it. Since big pastors went after big pockets, true Biblical teachings went down seriously and then this also allowed politicians to buy them.

Ozekhome, a road side mechanics lawyer, Gazette, a fake new blog, Headless mob, a bunch of social media puppets. The key question is, what was the charge against the defendant before the court?.. he wasn't charged for self defense, rather he was charged for manslaughter and the penalty for that is a death sentence. Both the prosecuting and defense counsels know this and they could have amend the charge sheet before approaching the court. The court of Lew doesn't mot give a foock about your emotions, the reason you keep wailing after you lost an election, instead of you learning and getting yourself enlightened. They keep manipulating your emotions because you are ignorant.

I reading about this case some time ago - Mr. Sunday was stabbed severely in the leg during the encounter. How then do you expect him to outrun the assailant?

Most of these life-death encounters, it's easy to analyze them from the safety of our homes. In the heat of the moment, with one's life hanging on a loose thread, with adrenaline pumping in magnanimous doses, and with dire split-second possibilities, the human body is only programed to do one thing - flight or fight. When flight is no longer possible, fighting your way out becomes the only available option.

Let's just say the Nigerian state has been defeated by its attackers. The Fulanis do as they please, our armed forces are demoralized, corrupt, and overstretched...and our judiciary is just an embarrassment. This is the case when we allow tribalism and religious sentimentalism to invade our thinking faculties.

How many people (you and I included) will act otherwise? You have an attacker willing to end your life, you are badly stabbed in the leg, possibly bleeding out with ambulatory functions compromised, what would you do? Run? Can you outrun your attacker? that there has also been an extensive history of Fulanis allegedly smiting these farmers at will. Of course, Sunday didn't want to be the next statistic - I wouldn't.

It's just sad that we are what we are in this country. One of the mandatory steps to take to liberate Nigeria is to squarely face religion and tribalism. Put out some mad laws, no matter how extreme. Take these two things away from the Nigerian complex and you'd find that our problems are quarter-solved....if not half.

d man he unalive is also a Nigerian. Not all herdsmen are violent, not all Northerners are herdsmen. No fulani man deserves to die just because he came from a violent clan.

But for death sentence, i thought this sentence is obsolete by now. The sentence is harsh though.

Even if he was not stabbed in the leg, I think it's only in Nigeria's courts that I'm hearing that when you overpower your attacker, you should run and not look to disarm him from further attempting to do you harm.
Professionals will tell you that you're most vulnerable when your back is towards your attacker which is exactly what happens when you run. He could get a stone and aim at you for example.
Self-defence is a universally acknowledged right. Even in the US, anyone who breaks into your house uninvited can get a bullet from you and you'll be within your right cause he invaded your private space.
I guess the SC is saying if an intruder breaks into your home in the night, you should first ask him if he's armed and then offer him some money in exchange for him leaving you alone instead of looking to contain his threat
