The Supreme Court on Friday, April 14, ordered an Ondo State lawmaker, Ifedayo Abegunde, representing Akure South/North Federal Constituency, to vacate his seat following his defection from Labour Party (LP) to the defunct Action Congress of Nigeria (ACN).

A Seven-man of Justices of the court, headed by the Chief Justice of Nigeria, Justice Mahmud Mohammed, declared that Abegunde is not fit to remain at the legislative house, noting that the lawmaker acted illegally by abandoning the party that sponsored his election.

It said that the lawmaker’s defection to another party would have been justified if there was a division in the national structures of the LP, such that is capable of impeding the smooth operation of the party.

The Supreme Court stated that the “division” or “factionalisation” of Labour Party, which was cited by the lawmaker as his excuse for abandoning the party, was only at the state level.

Abegunde was elected into the parliament on the platform of the ruling Labour Party (LP) in the April 2011 general elections, but defected to the Action Congress of Nigeria (ACN) after a few months in the House.

Labour Party subsequently began a recall process against him and approached the court to sack the decampee lawmaker in order for the party to reclaim his seat.

The lawmaker also filed a counter motion seeking judicial protection against his recall by the Ondo State House of Assembly.

The case will be thrown out by the court as Labour Party has no locust standing or business meddling in the affairs of the assembly they are not a part of.
Labour Party is a ed political party whose are interested in contesting election to fill the vacancies created by the defection of 27 of Rivers State House of Assembly. Now you understand why it concerns them to go to court to ask for their seats to be declared vacant?

Court ruled there are steps to take to effect a defection according to the constitution which the lawmakers didn't take smartly or by mistake I don't know.The party they defected to their names weren't on the .
Pdp or Fubara men should have codedly allowed them to complete the process of defection before they strike but gragra something no allow them.They sha wanted to impress Fubara as though na them Sabi play politics.

Just like pastors and native doctor, no lawyer will ever advise you not to pursue a matter in court, irrespective of lame your claim, they say ‘let’s go ahead’. If they don’t go to court, they don’t make money.

I think they tends towards due process.

The case of that LP lawmaker, he defected at the floor of the house..and his defection was announced at the floor of the house by the speaker.

Then, the Labour party that sponsored him now approach the court to sack him.


This is due process the PDP in Rivers State should have taken. Not demolition the house of assembly.

I am not a lawyer..but this is what I can understand from Supreme Court judgement. It's only the speaker that can declare defection and then, aggrieved parties will approach the court. That's due process

This is what happens when illegality thrives in the justice system. Ordinarily there should never be a switch of party once elected or voted in but it becomes confusing when another judge rules that it's normal thereby laying the foundation for lawlessness.

How can say that a party that duly contested in the election, and will also be qualified to participate in a bye election if the seats are invalidated has no locus stand to file the case?

They are meddlesome interloper. The defection did not in anyway affected them. The governor, PDP, and the 4 assembly are the only one that can challenged their defection. And above all, supreme Court has laid the matter to rest.

Any Judge whatsoever that gives a judgement contrary to the SP judgement will be thoroughly sanctioned.
Did you read the supreme court judgment? The supreme court DID NOT address the issue of whether they left the PDP but addressed the fact that they didn't APC. These are two very different things. And that's why there has been calls for the supreme court to definitively put this matter to rest by addressing the first point. So the matter isn't finished yet sir

They court have the jurisdiction to entertain the case.
The court can declare the seats vacant if the prosecution presents sufficient evidence to prove the defection.

The supreme Court judgment was based on technicalities, because there were no material evidence from fugbara camp to prove the allegation of defection.

Fugbara made the mistake of withdrawing the original case and merging it for expedited judgement, however another interested party has filled the case with proper documented evidence.

if you can understand what is going on here is that...
The supreme Court was not officially supposed to rule on that defection matter because the case was not officially presented to the supreme Court for ruling.
