You got it wrong, if the judgement didn't go there way... All they need to do is to secure stay on execution, then file for appeal till the supreme Court level. Your guess is as good as mine before the supreme Court make pronouncement on it, their dispensation will come to an end!!

They have already given reasons to their defection cited the division in the office of the national secretary. Technically (not legally), their reasons seem genuine cos the istrative arm of the party was collapsed. These and many others make it difficult for the national to response to their memos hence form the part of defection.
