Jobs may be hard to come by but you'll likely get something if you apply to leeds /Newcastle and maybe Bradford. Would be smart to tailor your cv and start applying like 2/3 weeks before coming into the UK

My friend and his wife are in Sunderland and she's been finding it hard to get something but interviews have been coming. Would be smart to also look at remote roles depending on the industry the dependent is

According to gov UK:

Discounts for full-time students
Households where everyone’s a full-time student do not have to pay Council Tax. If you do get a bill, you can apply for an exemption.

To count as a full-time student, your course must:

last at least 1 year
involve at least 21 hours study per week
If you study for a qualification up to A level and you’re under 20, your course must:

last at least 3 months
involve at least 12 hours study per week
You’ll get a Council Tax bill if there’s someone in your household who’s not a full-time student, but your household might still qualify for a discount.

So they have to pay council tax, but should apply for a discount from the council on the basis of the student being disregarded/exempt.

They have to apply for the discount though - it's not automatic. In any case they definitely should not ignore letters from the council because the council has the power to take enforcement action to recover the debt, which could result in a court summons, bailiffs or even a prison sentence. Croydon council is bankrupt and will not joke with its money. It recently hiked up its council tax by a substantial amount even though there are many struggling households in its borough.

Edited to add - bear in mind they will also be liable for the tax arrears that has accumulated. They should engage asap with the council to try to agree a payment plan.

I just did some more digging around and it seems the official guidance is a bit nuanced when it comes to non-british spouse dependents of students.

Here it allows such dependents to be exempt from council tax if they are prevented by the of their leave to enter or remain in the UK from working or claiming benefits.

The "or" is confusing as it implies that the dependent can claim an exemption if they are not entitled to benefits (which would apply to almost all dependents). However the practical application seems to suggest that most councils treat it as an "and" clause i.e. a dependent is exempt if they are not allowed to work, and also cannot claim benefits.

it's worth highlighting this clause to the council to see what their response/interpretation is.

- Once a Main Applicant, always a Main Applicant.
- Once a Dependant, always a Depandant.

Please, i am confused here. Do you mean that when the MA is schooling while the dependant gets a job with COS and intends to be the MA for ILR, ILR start counting from when the dependant (new MA for ILR) starts working or when the former MA (new dependant for ILR) gets a job with COS?

Others want to see a copy of their port, which shows a stamp stating that they are prevented by immigration regulations to work or claim benefits in the UK.

So if their BRP shows that they are not entitled to work and also cannot take up benefits, then they have no means to pay and are disregarded.

I suggest they complete the exemption form from Croydon and provide the ing evidence and see what they say

They are not meant to pay shishi. A full-time student and non British partner dependent. This is clear on every council's website. When they disturbed me in my own council that year I quoted their site in my mail and we were exempted. In this UK study to show yourself approved on every matter or else pounds go just dey show you shege

Absolutely, the discount is to be made by the Council. Some Councils can give a total exemption, others a discount, and a few may stubbornly insist on collecting their money if there is an adult dependant occupant.

What I meant was that I and my dependents are currently exempted from paying IHS fee.

Lol, a broke council is an angry one.

Has the council given an explanation for why the dependent is not exempt?

Your friends could sit tight, since they're in the right, and see how far the council takes it. Worst case they might receive a court summons and have solid grounds to win against the council. Chances are the council will cave once their legal team gets involved.

Or, depending on their risk appetite, they could pay and then claim it back from the council.
