With the opening of the new Subclass 491 Regional Work visa only a day away, the Australian States and Territories are getting ready for the influx of EOI applications expected after 16 November. The following information has been made available so far. Victoria The Victorian Government will accept applications for state nomination for the 491 visa from 9am on Monday 18 November 2019. There is no fee to apply for nomination, and they can use any occupation on the Immigration skilled occupation lists. However, all applicants for the 491 visa are required to provide evidence of a current job offer in their nominated occupation, located in regional Victoria. Evidence of the employment offer, business operations, recruitment efforts, and genuine need must be provided with the application for state nomination. Queensland The state nomination program for General Skilled Migration remains closed, with advice that this will reopen 'in the coming weeks'. A number of occupations have been removed from the QSOL, including: Onshore and Offshore - IT ICT Business Analyst ANZSCO 261111 Systems Analyst ANZSCO 261112 Developer Programmer ANZSCO 261312 Software Engineer ANZSCO 261313 Software and Applications Programmers nec ANZSCO 261399 ICT Security Specialist ANZSCO 262112 Computer Network and Systems Engineer ANZSCO 263111 Analyst Programmer ANZSCO 261311 Onshore - ing ant (General) ANZSCO 221111 Management ant ANZSCO 221112 Taxation ant ANZSCO 221113 External Auditor ANZSCO 221213 Internal Auditor ANZSCO 221214 Offshore - Engineering Civil Engineer ANZSCO 233211 Mechanical Engineer ANZSCO 233512 Electrical Engineer ANZSCO 233311 Engineering Technologist ANZSCO 233914 Tasmania The requirements for state nomination for the 491 visa are not yet available, but should appear shortly after 16 November. From this date, applicants for both the 491 and 190 visa will be required to pay a $220 (incl. GST) application fee for nomination applications. This must be made via credit card (Visa or Mastercard) and is not refundable regardless of application outcome. South Australia Migrate SA closed their state nomination system for 190 visas from 11am on 15 November 2019, in order to make changes for the 491 visa. The system will reopen in the first week of December (exact date to be determined). Applicants for the 491 visa will open at the same time. Further information will be published in late November. New South Wales The NSW Government states that it will 'shortly advise' when they will open for 491 nominations, however, Regional Development Australia Northern Inland NSW, one of the regional bodies of the NSW State Government announced in a recent newsletter that a start date for 491 nominations 'will not begin until early 2020, hopefully January'. Specific details regarding eligible occupations and postcodes designated as regional areas will be also released in due course. Northern Territory The Territory page states that the 491 nomination system will be available from 16 November 2019, however, no further information on this process is available at the time of publishing. Western Australia The WA government has advised that EOIs for the 491 visa can be submitted from 16 November, however, the invitation process will not commence until 21 November 2019. Australian Capital Territory The ACT has advised that applications for nomination can only be submitted from 1 January 2020. This is following a release of new eligibility criteria for both the 491 and 190 visas, due on or before 28 November 2019. PTE Test Update PTE Academic test takers will soon be able to view and assign their test scores for up to 3 years (was 2years before) from their test date.This aligns with the Department of Immigration's validity period for English language tests. Results for tests conducted on or after 29 October 2019 will be available online for three years, making it easier for the Department of Immigration to test scores. Australia is set to introduce new regional work visas from 16 November 2019. The visa subclass 491 will offer 14,000 places each year for the foreign skilled workers living and working in regional areas. Permanent residency (PR) pathway is also available for eligible applicants and their families. The holders of these visas will be required to work and stay in the designated regional areas until they become eligible for permanent residency. They can apply for permanent residency after three years of stay and paid-work in a designated regional area.” this visa will replace the existing 489 visa that will cease from the 16th of November with the invitations from States and Territories already closed from the 11th of September 2019 This is a temporary visa which is available for eligible skilled workers and their families to live, work and study in regional Australia for 5 years. It is a point-based visa where an applicant requires either a state nomination or a sponsorship from an eligible family member who is settled in designated regional areas. Here are some key features of Skilled Work Regional visa (subclass 491) 14000 places to be allocated each year A wide range of occupations are eligible (over 500) Age limit is set at 45 years Visa to be granted for 5 years Must live and work in regional areas for at least 3 years before being eligible for PR Regional area is mainly anywhere except metropolitan Sydney, Brisbane, Gold Coast, Melbourne and Perth The applicant should be earning a minimum wage of $ 53,900 per annum for three years (concessions may apply) Visa holder is allowed to move from one regional area to another PR pathway available through visa subclass 191 that will commence from 16 November 2022 Visa is available for an application fee of $4,045 and the partner fee is set at $2,025. Difference between the 489 visa (ceased) and 491 visa The 491 visa holders will now have to wait for 3 years for PR while it used to be 2 years in the visa subclass 489. The new visa covers more regional areas compared to 489 visa. The areas where the holders of 491 visa can live include all areas in Australia except metropolitan Sydney, Melbourne, Brisbane, Gold Coast and Perth. The areas of Newcastle, Wollongong and NSW Central coats have also been added to the list. There will be more points available under the new visa – unmarried or single applicants will get extra points that serve as a bonus for bachelors and there will be more points to avail for eligible relative sponsors and skilled partners with competent English. This visa is going to be very competitive so we would suggest that the prospective applicants should immediately get ready with their applications, lots of people who are stuck on 189 and 190 and 489 queue are application ready and thy will switch lanes come NOV 16, so if you are still sitting on the fence, you may want to reconsider your stance This is a temporary visa that can set a pathway for PR for eligible applicants. The visa holders will need to stay and fulfill work requirements in a regional area for 3 years before being able to file 191 visa leading to permanent residency. Visa restrictions and flexibility The visa holder will not be granted any permanent skilled or onshore partner visa for the duration of 3 years unless there are compelling circumstances. You can apply for 189/190/187/186 and the likes. this move will lock migrants into the regional areas before they get their permanent residency. this will also the regional area's economy. Visa holders cannot live and work outside the designated regional areas but are allowed to move from one regional area to another these conditions would be monitored closely and non-compliance may result in immediate visa cancellations. applicants should not ‘cross the limits’ or apply any ‘shortcuts’ to claim extra points. “There is a possibility that some dodgy applicants may try to cheat the system by divorcing or separating from their partners to gain extra 10 points,” he said. “Your whole profile and motive will be under scrutiny again when you lodge your PR under subclass 191.
